新版集成电路布图设计保护条例正式落地 全方位护航国产芯片产业创新发展

近日，国务院公布新修订的《集成电路布图设计保护条例》，这也是该条例实施二十多年来首次系统性全面修订，聚焦芯片产业创新痛点、知识产权保护短板，打出制度升级组合拳，为我国集成电路产业高质量发展筑牢法治屏障。新规落地后，将全面适配当前芯片技术迭代快、产业规模扩容、侵权形式多样化的行业现状。
本次修订内容覆盖面广、针对性强，重点扩展了集成电路布图设计的法律保护范围，填补了新型芯片架构、先进制程设计的保护空白，让各类创新设计成果都能得到完整法律保障。同时优化简化申请登记、审查流转流程，压缩审批时限，降低科创企业维权、登记、确权的时间和资金成本，极大提升知识产权服务效率。
此外，新规大幅加大侵权惩处与赔偿力度，明确细化侵权认定标准、赔偿核算方式，严厉打击恶意抄袭、盗版复刻、非法商用等侵权行为，有效遏制行业低价内卷、恶意竞争乱象。作为芯片产业核心配套法规，新版条例将充分激发企业研发创新积极性，助力国产芯片突破技术壁垒，推动集成电路产业自主可控、提质增效，夯实数字经济核心产业根基。
